Terms and conditions of sale and use

IDENTIFICATION OF OPERATOR AND SITE OWNER

CYC BUSINESS SAS owns and manages the Site.
It is registered with the Registre du Commerce et des Sociétés de Lyon under number 948 805 536 and its head office is located at 100 quai Charles de Gaulle 69006 Lyon France.

PRICES

– Prices indicated on the site –

The prices indicated on the site and at the time of payment are inclusive of all taxes.
In the context of Illustraworld’s temporary discount programs, the prices indicated take into account the discounts applied.
On the website, our prices range from €9.90 to €100.

– Quotation prices –

A quotation drawn up for a customer indicates the amount before tax and all taxes (quotation for personalized illustration for more than ten people).

ORDERS / PRODUCTS

– Order on the site –

Creation of a customer account:

Customers may place orders on the site provided they are logged in to their account. If they do not yet have an account, they can create one when validating their order.
The customer must complete a form in which he/she enters the information required for identification, in order to obtain identification and create a personal account. This includes a login, email address and password.
To log in, the customer must then identify himself by entering his email address and password.
The password is personal and confidential. Customers are entirely responsible for the use and preservation of their password. Customers undertake to do everything in their power to keep their password secret and not to divulge it to anyone. At the end of each order, the customer must disconnect from the site. In order to preserve the confidentiality of the password.

In the event of loss or unintentional disclosure of information that could enable a third party to gain knowledge of a customer’s password, it is possible to change the password on the My Account page, under the heading “Edit my account”.
If you have forgotten your password, go to the “Forgotten password” section below the login area.
The customer will then receive an email to reset their password at the email address given when they registered.

Products and ordering process:

Customers can choose between :
– Personalized illustrations ranging from 1 to 10 people on the base photo.
– A product from the “background illustrations” category (personalized or cities).
– The “2-person couple illustration” product, for which a date and two first names must be entered.
– The minimalist drawing product
– A gift card
– Additional quantity(ies)” product

Depending on the category and the number of people in the photo, we charge a different price.
Pets and newborns count as one person.
Prices also vary according to the options chosen.
It should be noted that each of the products available on the site is in fact subject to options to be selected by the customer for the purposes of ordering the desired product.

For some products, customers can choose the background they want:

1 – A plain pastel pink background (just the people in the photo + pastel pink background)
2 – A plain pastel blue background (just the people in the photo + pastel blue background)
3 – A plain pastel green background (just the people in the photo + pastel green background)
4 – A plain brick-orange background (just the people in the photo + brick-orange background)
5 – A plain taupe background (just the people in the photo + taupe background)
6 – A plain beige background (just the people in the photo + beige background)
7 – A personalized background (the people in the photo and the photo background)

The customer then chooses the format:
1 – Digital (receive a JPEG version by e-mail)
2 – Digital + A3 Print (JPEG version received via Internet and A3 paper copy by post)
3 – Digital + A4 Print (JPEG version received via Internet and A4 paper by post)
4 – Digital + A5 Print (receiving a JPEG version via the Internet and an A5 paper copy by post)

Then the customer chooses whether or not to take the eyes and nose option (illustration of the eyes and nose on the people in the photo):
– Yes
– No

The eyes and nose option is subject to additional charges, depending on the number of people in the photo. If the customer chooses the eyes and nose option, he must enter the eye color in the space provided on the product page. Be sure to describe the people you’re talking about. For example: the person in the green T-shirt has brown eyes, etc. If the customer doesn’t enter a color in the space provided. What’s more, it’s impossible to distinguish the color of the person’s eyes. In this case, the illustrator will choose the eye color.

The customer must also indicate the hair color of the people in the photo. He must be careful to describe the people he’s talking about. For example, the person in the green T-shirt has brown hair, etc. If the customer doesn’t enter a color in the space provided, then the illustrator will choose the hair color.

The paper used is photo paper.

Finally, the customer must upload a photo. Our team of illustrators will illustrate this photo. The photo must be of good resolution and not blurred. We need to be able to distinguish details in order to illustrate them. Similarly, the number of people in the photo must correspond to the product purchased.

Format of JPEG received by e-mail (digital version) : Approx. 4961 x 3508 pixels.

Landscape or portrait mode:

Note that if the uploaded photo is in portrait mode, the illustration will be in portrait mode.
Please note that if the uploaded photo is in landscape mode, the illustration will be in landscape mode.
If the uploaded photo is a square format, we inform the customer on the product page that it is up to him to indicate this in the “Special remarks” section. If the customer does not indicate this, the illustrator will choose.

– Order process –

All customer orders imply unreserved acceptance of the prices and descriptions of the products ordered.

From the references available on the site, customers select the products they wish to purchase by clicking on the “Add to basket” button.
At all stages of the order process, the customer can consult and modify the contents of his or her order. To this end, they can click on the “Cart” button to the right of the menu.
Having selected the products they wish to purchase and checked the contents of their order, customers can proceed to finalize their order by clicking on the “Confirm order” button.

The customer then completes and validates the order. First, he/she must check the order summary. Secondly, they must read and accept the present terms and conditions. Finally, he/she must enter the information required for payment.

Once the customer has paid the order price, validation of the order is definitive. Until the order has been validated, the customer may cancel or modify the order at any time. When paying, the customer must confirm the contents of the basket.
In order to combat fraud, Illustraworld reserves the right to ask the customer for any document necessary to verify his identity, the authenticity of his means of payment and/or his place of residence.
Once payment has been made, the customer will receive an e-mail summarizing his order.

CUSTOMER-SUPPLIED FILES

For all orders, the customer must upload a photo. Our team of illustrators will illustrate this photo.

First of all, the photo must be of good resolution, not blurred. Indeed, we need to be able to distinguish details in order to illustrate them. Finally, the number of people in the photo must correspond to the product purchased.
Illustraworld executes orders on the basis of files supplied by the customer.
In the event that a file does not conform to the technical specifications or to the product purchased, Illustraworld will contact the customer by e-mail to inform him of this. In addition, Illustraworld will request the transmission of files corresponding to Illustraworld’s technical requirements or to the product purchased. In the absence of such transmission, we will cancel the order under the conditions set out below (“Refusal and cancellation of order”).
The customer is entirely responsible for the integrity and accuracy of the files transferred.
Except in cases where files are illegible, cannot be processed or clearly present a defect that seriously calls into question the quality of the work of the team of illustrators, in which case the customer will be informed before the service is carried out, Illustraworld is not subject to any control obligation. This includes, but is not limited to, the editing of visuals, spelling, photo credits or the presence of mandatory legal notices.
Please note that Illustraworld only accepts JPEG and PNG files.

INVOICE

When ordering, the customer accepts that invoices will be sent electronically. In fact, no invoice will be attached to the parcel if a parcel is sent.
Please note that the invoice is available as soon as the order is validated. In fact, it is available at any time from the customer account.

PAYMENT

The customer pays the price in full at the time of ordering.
In fact, the order will only be definitive once payment has been received. The latter is only considered as such after the effective and complete collection of the sums due.
At the end of the online ordering process, the following payment methods are available: Credit card.

CONDITIONS FOR USING THE DISCOUNT COUPON

Illustraworld may distribute coupons entitling the holder to an absolute or percentage reduction in the price of a purchase.
Unless otherwise stated, a coupon is valid only once (per person or company).
Some coupons have a limited duration, specified in advance.
Some coupons are not cumulative.

ORDER REFUSAL AND CANCELLATION

Illustraworld reserves the right to refuse the order in cases where the parts and files supplied by the customer do not conform:
– If the photo is not of good enough quality to distinguish details
– If the number of people in the photo does not correspond to the product purchased.
In these cases, Illustraworld will notify the customer. We will ask them to provide us with another file.
If he cannot provide us with another file corresponding to his order, he will be reimbursed.

In addition, Illustraworld reserves the right to cancel any order and permanently delete the customer account in the event of verbal abuse. It also reserves the right to cancel orders in the event of physical violence towards its personnel. While recognizing that the use of foul language is part of verbal abuse. If the file sent is contrary to the law (racism, anti-Semitism, xenophobia…), Illustraworld also reserves the right to cancel the order.

ABSENCE OF WITHDRAWAL

As the customer is not a consumer, the right of withdrawal provided for in the French Consumer Code does not apply.

Indeed, article L. 221-28, 3° of the French Consumer Code specifies that the right of withdrawal provided for in the case of distance selling cannot be exercised for the “supply of goods made to the consumer’s specifications or clearly personalized”.

If the illustration work by the illustrator has not yet begun, Illustraworld agrees to reimburse a person who wishes to cancel their order, but the bank charges (charges levied by Stripe for each transaction) will not be reimbursed.

DELIVERY - DIGITAL SUPPORT

Together with our team of illustrators, we do our utmost to ensure that you receive your product as quickly as possible. Unfortunately, we can’t guarantee a specific delivery time. This depends on the number of orders we receive and the time it takes us to expand our team.
You’ll find the current average delivery time on our homepage.

Once ready, you’ll receive your personalized illustration by e-mail.

DELIVERY - PRINTED MEDIA

Delivery times are given in working days.

Packages are generally dispatched within 1-3 working days of receipt of the digital version.
Mondial Relay or Colissimo dispatch them (with a tracking number) and deliver them to your home or to a relay point.

Shipping costs include VAT and vary according to the total weight of the parcel. Illustraworld recommends that you combine all your items in a single order. Illustraworld cannot group two orders placed separately, and shipping fees will apply to each of them. We make every effort to ensure that your items are as secure as possible, but we are not responsible for their handling once they have been handed over to our carrier. However, we can find solutions if your items are damaged.

In the case of shipment, Illustraworld makes every effort to ensure that the order reaches the customer as quickly as possible.
Illustraworld cannot be held responsible for delays in delivery if they are caused by :
– An incorrect or incomplete address; or
– Repeated absences of the customer from delivery times.

RETURNS DUE TO ABSENCE OR INCORRECT ADDRESS

The customer has taken possession of his order as soon as the parcel has been delivered (by the carrier).

In the event of Illustraworld’s delivery being returned, we will keep the parcel for one month. After this period and after notifying the customer by e-mail, the goods will be destroyed. If the customer chooses to return the package, Illustraworld reserves the right to charge the customer a return fee (shipping costs equal to those paid for the first shipment) per package to be returned.

PACKAGE DAMAGE

The customer must report any damage to the package on the delivery slip or to the carrier immediately upon delivery. The customer then has two working days to notify Illustraworld so that Illustraworld can take action against the carrier. No claim for damage due to transport can be taken into account after these two days following receipt of the parcel.

DELIVERY METHOD

With Colissimo or Mondial Relay, at a relay point or at home.

QUALITY OF PRINTED PRODUCTS

Please note that Illustraworld cannot guarantee 100% color fidelity. Therefore, the customer accepts that there may be variations in the color of illustrations. Also, minor anomalies may have escaped Illustraworld’s surveillance.

Similarly, Illustraworld cannot restore a color or rendering identical to the file viewed on the screen or printed by the customer’s printer or that of a third party. The rendering of a file on the screen can in no way be compared to the rendering after printing.
In the event of reprinting, even from the same file, print renderings may not be identical.
Because Illustraworld has its own technical constraints, and consequently its own specifications, it cannot render work identical to that produced by its colleagues.
To avoid any risks, Illustraworld strongly recommends that customers respect the technical specifications (unblurred photos). Illustraworld cannot be held responsible for any failure to comply with these recommendations.
Illustraworld cannot guarantee perfect similarity between media (paper, structures, packaging, etc.) from one order to another.

PRODUCT WARRANTIES

Ink shades and paper quantities are only guaranteed within the tolerances accepted in the printing industry. The customer therefore accepts that there may be minor defects on the entire print run, invisible to the untrained user. For example, chips, slight variations in color, intensity or cutting.
Likewise, the customer accepts that the finished format may vary by up to 7% (in relation to the initial format ordered).
By express agreement between the parties, Illustraworld submits to an obligation of means for the performance of its obligations under the services, subject of these GTC.
Illustraworld cannot be held responsible for material damage to buildings. It is also not liable for damage to the Customer’s installations, movables, tangible or intangible property.

In addition, the customer waives the right to hold Illustraworld liable for any damages suffered by him or by third parties having used, directly or indirectly, the work Illustraworld performs.

De la même manière, Illustraworld ne saurait être tenue responsable des pertes directes ou indirectes que pourraient subir le client ou des tiers, du fait des prestations exécutées.
Dans le cas où une condamnation serait prononcée à l’encontre de Illustraworld. Toutes causes confondues, principal, intérêts et frais. Les parties conviennent que Illustraworld ne sera pas tenue à un montant supérieur au coût global de la prestation en cause visée dans les conditions particulières (Commande) aux présentes.
Illustraworld ne garantit que les articles qui sont régulièrement devenus la propriété du client. Les défauts et détériorations des articles livrés consécutifs à des négligences imputables au client. Mais encore à des conditions anormales de stockage chez le client. Notamment en cas d’accident de quelque nature que ce soit ne pourront ouvrir droit à la garantie que doit Illustraworld. La réception sans réserve des articles que le client commande couvre tout vice apparent et/ou manquant. La réclamation qu’émet le client selon les modalités décrites par le présent article ne suspend pas le paiement des articles concernés.

Illustraworld only guarantees items that have regularly become the property of the customer. Defects and deterioration of items delivered as a result of negligence attributable to the customer. Unconditional acceptance of items ordered by the customer covers any apparent defect and/or shortage. CLAIM

The customer issues all complaints relating to online orders. They must be made by e-mail or via the contact form on the “Contact” page. The customer must report the anomaly by providing all the information necessary for Illustraworld to process the request as quickly as possible.

All complaints must be made within fifteen days of the actual delivery date. Complaints concerning a missing quantity or a damaged package. They must be made within forty-eight hours of receipt of the goods (even in digital format).
In the event that the elements provided by the customer do not allow us to ascertain the anomaly reported. The goods (unused by the customer) must be returned (at the customer’s expense). Illustraworld will make a decision only upon receipt of the goods.
Illustraworld will inform the customer within forty-eight working hours of receipt of the request and the response.
Commercial gestures (or compensation) following a complaint are exclusively in the form of a credit note valid on the site.
It is possible to contest the decision of the After-Sales Service. Within seven days of the closure of the initial claim. After that date, all complaints may be rejected. After two objections, our services will close the claim definitively.

INTELLECTUAL PROPERTY

The customer is solely responsible for the content of the products once they have been personalized with elements supplied by the customer. He declares that he has all the necessary rights and authorizations to insert objects, images, brands, photos, logos and drawings in the products he orders. Furthermore, he guarantees Illustraworld that these rights and authorizations are valid. Finally, that the use of the products does not and will not constitute any violation of the rights of a third party.

Likewise, the customer is solely responsible for any omissions.
The customer also declares that the products ordered are not likely to constitute forgeries or to infringe the rights of third parties and, in general, that the creation and production of the products will not contravene any right, rule or legislation in force.
Consequently, the customer indemnifies Illustraworld against all actions and claims arising from these rights and undertakes to compensate Illustraworld for all consequences resulting from any action brought by third parties who consider themselves injured by the printing, distribution and, in general, the use of the products ordered.

COMMERCIAL USE

Illustrations purchased by the customer, whether personalized or not, cannot be used for commercial purposes. In other words, the customer may not resell the illustration created by Illustraworld. This applies to all media: paper, textiles, tableware….

VALIDITY

If any provision of these GTC is or becomes null and void in whole or in part, the remaining provisions shall remain in full force and effect. The legal regulation replaces the null and void stipulation.

PERSONAL DATA

Illustraworld is committed to respecting the privacy of the customer, as well as the security and confidentiality of data and information of a personal nature. The customer is the one who communicates this information.

As part of the collection and processing of personal data, Illustraworld provides the Customer with all the information relating to the conditions for processing personal data and the rights available to the Customer as part of its personal data protection charter accessible on the site.
As a reminder, the customer has:
1 – the right to access all their personal data that is being processed;
2 – the right to request rectification;
3 – the right to request the deletion of such data;
4 – the right to request that the data be restricted;
5 – the right to object at any time to the processing of personal data for canvassing and/or statistical purposes;
6 – the right to define directives relating to the conservation, deletion and communication of their personal data after their death;
7 – the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés.

DISTRIBUTION OF THE PHOTO AND/OR ILLUSTRATION ON ILLUSTRAWORLD'S WEBSITE AND SOCIAL NETWORKS

When validating the order, we ask the customer to choose whether they wish their photo and/or illustration to be published on Illustraworld’s website and social networks:

– Yes, photo and illustration
– Yes, just the illustration
– Yes, just the illustration
In the event that the customer chooses “Yes” (photo and illustration or just illustration), they take responsibility for the agreement of all persons present in the photo / illustration. Illustraworld will not be held responsible in the event that a customer accepts that their illustration and/or photo be published on their website and social networks while one of the people in the photo has not given their consent. It is up to the customer who takes the decision to ensure that everyone agrees.
Similarly, if the customer chooses “Yes” (photo and illustration or just illustration), they take responsibility for ensuring that they do not need the agreement of a legal guardian concerning their image rights (particularly for minors).
From one week after receipt of the order by the customer (receipt of email if digital format / receipt of package if printed format), Illustraworld will post on its website and / or its social networks the photo and illustration (or just the illustration depending on what the customer has chosen).
